href=\"https:\/\/www.cbsnews.com\/news\/tulsi-gabbard-political-battles-2016-election-documents-russia\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">2016 election<\/a><\/span>.<\/p>\n<p>She has directed Justice Department staff to begin legal proceedings and ordered a federal prosecutor to present evidence to a grand jury about the matter to secure a potential indictment, according to a source familiar with Bondi&#8217;s efforts. It is unclear what the charges would be and who would be charged.<\/p>\n<p>The directive follows a criminal referral from Director of National Intelligence <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/gabbard-releases-russia-documents-concerns-intelligence-sources\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Tulsi Gabbard<\/a><\/span> in mid-July. The Justice Department confirmed it had received the referral.\u00a0<\/p>\n<p>The Justice Department has not responded to a request for comment.\u00a0<\/p>\n<p>Last month, Gabbard <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/tulsi-gabbard-political-battles-2016-election-documents-russia\/\" data-invalid-url-rewritten-http=\"\">released more than 100 pages<\/a><\/span> of declassified files about Russia&#8217;s actions during the 2016 presidential election, reigniting a nearly decades-long political battle about the U.S. intelligence community&#8217;s handling of intelligence.<\/p>\n<p>Her office alleged in a <a href=\"https:\/\/www.odni.gov\/files\/ODNI\/documents\/DIG\/DIG-Russia-Hoax-Memo-and-Timeline_revisited.pdf\" target=\"_blank\" rel=\"nofollow noopener\">memorandum<\/a> released with the files that they contained what she called evidence of &#8220;suppression&#8221; and manipulation of the intelligence underlying a 2017 community-wide <a href=\"https:\/\/www.dni.gov\/files\/documents\/ICA_2017_01.pdf\" target=\"_blank\" rel=\"nofollow noopener\">assessment<\/a> of Russia&#8217;s efforts to interfere in the 2016 presidential election.\u00a0<\/p>\n<p>The files included email exchanges, excerpts from a President&#8217;s Daily Brief and a readout from a principals committee meeting, chiefly from a period during the Obama administration.\u00a0<\/p>\n<p>In a <a href=\"https:\/\/www.odni.gov\/index.php\/newsroom\/press-releases\/press-releases-2025\/4086-pr-15-25\" target=\"_blank\" rel=\"nofollow noopener\">statement<\/a> and social media <a href=\"https:\/\/x.com\/DNIGabbard\/status\/1946271402971312514\" target=\"_blank\" rel=\"nofollow noopener\">posts<\/a>, Gabbard claimed the materials, which were marked declassified on July 17, 2025, were evidence of a &#8220;treasonous conspiracy&#8221; and &#8220;years-long coup&#8221; plotted by Obama administration officials against Mr. Trump, and said she would forward them to the Department of Justice as part of a criminal referral.\u00a0<\/p>\n<p>Democrats have fiercely disputed her claims, pointing to the findings of a bipartisan Senate <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/senate-report-russian-interference-2016-us-election\/\" data-invalid-url-rewritten-http=\"\">investigation<\/a><\/span> that concluded Russia had attempted to influence the 2016 election.
